Event Description
In recent years, the U.S Supreme Court has issued several landmark decisions that directly or indirectly impact health care and medical research. It has, for instance, ruled on issues of religious and conscience objections to providing or receiving treatment, on the right to abortion and gender-affirming treatment, on the ability of the executive to cut off research and AIDS funding. In support of those and other decisions, the Court has increasingly invoked unusual legal theories and doctrines, such as originalism, the unitary executive theory, the major questions doctrine, the end to deferential review of agency interpretations, and the so-called shadow docket. This program will offer brief comments on the impact of recent Supreme Court decisions on bioethics, and then engage in a moderated discussion of the topic.
